Access to www.emprendedorXXI.com or whatever website may replace it in the future (hereinafter, “the Portal”) and any queries of the information contained therein, as well as any contracting that may occur through the Portal and/or the use of the services, whether free or paid, entails the User’s acceptance of the terms and conditions provided in this Legal Notice. Therefore, we recommend that users read its content carefully.
Validity of the Legal Notice
CAIXA EMPRENDEDOR XXI, S.A., based in Barcelona, Avenida Diagonal, número 621, Torre I, with Tax ID No. (NIF) A63495550, registered in the Commercial Registry of Barcelona in Volume 43,533, Folio 133, Page No. B-282,414, is the owner and manager of the Portal (hereinafter, the “Owner of the Portal”).
The Owner of the Portal reserves the right to modify the conditions set forth in this Legal Notice at any time, in which case, they will enter into force upon their publication and will be applicable from that date.
Unless expressly stated otherwise, the contents of the Portal, in particular references related to resources, tools, and services, do not constitute a binding offer. The Owner of the Portal reserves the right to make changes to or omit, whether in whole or in part, the current contents whenever it deems necessary, as well as to impede, restrict, or suspend access to the Portal temporarily or permanently.
In no case shall it be understood that making services, information, resources, and/or tools of any kind available from the Portal constitutes any type of provisioning of services, commercial offering, and/or contractual relationship with the Owner of the Portal or otherwise create obligations for the latter, unless specifically expressed otherwise.
Definitions:
The following definitions will be used for the purposes of the provisions of this Legal Notice:
User: Any person who visits the Portal.
Entrepreneur: Individual or legal entity wishing to create, develop, or consolidate projects or initiatives in business, research, or innovation, and is registered on the Portal for the purpose of making use of resources, tools, and services of any kind to which they may have access from the Portal for the performance and/or development of their own project or for advising on any of the aspects linked thereto.
Investor: Individual or legal entity registered on the Portal and interested in promoting or participating in the financing of projects by Entrepreneurs in various activity sectors.
Expert: Individual or legal entity registered on the Portal, endowed with experience and knowledge that may be useful for an Entrepreneur, and wishes to provide such knowledge whether through commissioning new projects, providing content to the Portal, and/or providing assistance and advising to Entrepreneurs, whether online or by any other means.
Collaborating Entity: Entity with its own legal personality that, not having the qualification of being an Investor or Expert, provides the Portal with any kind of content or educational and informative offers in certain areas, in collaboration with the Owner of the Portal.
In any case, whenever any person collaborating in the provisioning of content to the Portal is offering a product or service through the Portal, they must expressly indicate that they are doing so, exempting the Owner of the Portal from any liability derived from the fulfilment or breach of any obligations that may be contracted, as well as from any liability derived from any infraction that it may incur in virtue of regulations related to Advertising, Intellectual or Industrial Property, Unfair Competition, Personal Data Protection, Consumer and User Protection, or any other kind.
In particular, the management of the Portal by its owner shall not be understood to entail the owner’s participation in and/or linking -as a party- to contractual and/or commercial relationships or relationships of any other type that may be established among Users, nor will the owner therefore be liable by any means in the fulfilment of any obligations that may be derived from the aforementioned relationships. For these purposes, it will be understood that any User acts independently and autonomously in their relationships with other Portal Users.
Intellectual and Industrial Property:
The content of the pages that make up the Portal may include texts, documents, multimedia works, photos, drawings, logos, marks, trade names, internet domain names, or other distinctive marks protected by industrial and/or intellectual property rights or image rights of which the Owner of the Portal or the individuals or legal entities participating in providing the content to the Portal, or which are authorised to use such for that purpose, are either owners or legitimate licensees, whether they be Entrepreneurs, Experts, Investors, Collaborating Entities, or Users.
Any form of exploitation, including any type of reproduction, distribution, third-party assignment, making available or public communication, and transformation, by any means of support or medium, of the aforementioned works, creations, and distinctive marks, without the prior and express authorisation of their respective owners is prohibited. Failure to comply with this prohibition may constitute an infraction punishable by the current legislation in force.
However, a User, on their own account and risk, may download or make a copy of such elements exclusively for their personal use, without this meaning an authorisation or licence on the property rights of the Owner of the Portal or of the aforementioned third parties. In particular, the User may not alter, modify, or delete, whether in whole or in part, any of these elements or, in general, infringe upon any of the intellectual or industrial property rights of the Owner of the Portal or third parties.
In addition to the above, the content of the Portal, in particular any inventions whose features are outlined in the Portal and/or form part of the projects promoted by Caixa Emprendedor XXI, may be covered by intellectual property rights and/or protected as patents, utility models, trademarks, trade names and/or shop signs, even though this circumstance is not expressly mentioned, thereby prohibiting any means of exploiting them, including all kinds of reproduction, distribution, transfer to third parties, public communication, and transformation, by any means of support and medium, except as expressly authorised by its owner.
Except in cases expressly authorised by the Owner of the Portal, it is prohibited to create links or hyperlinks between third-party portals or websites and the Portal or to present, whether in whole or in part, web pages from the Portal or the information contained therein under frames or macros, distinctive marks, third-party company or trade names that otherwise are associated with the image or trade name of the Owner of the Portal and may induce error, confusion, or deception.
In any case, whenever any person collaborating in the provisioning of content to the Portal is offering a product or service through the Portal, they must expressly indicate that they are doing so, exempting the Owner of the Portal from any liability derived from the fulfilment or breach of any obligations that may be contracted, as well as from any liability derived from any infraction that it may incur in virtue of regulations related to Advertising, Intellectual or Industrial Property, Unfair Competition, Personal Data Protection, Consumer and User Protection, or any other kind.
The Owner of the Portal does not grant any guarantee on the accuracy, lawfulness and/or legality of the information or elements contained in the pages of the Portal whenever said information or elements has not been prepared or is not owned by said owner.
Liabilities:
The Owner of the Portal does not guarantee continued access, or the correct visualisation, downloading, or utility of the elements and information contained in the Portal, which may be impeded, obstructed, or interrupted by circumstances beyond its control.
The Owner of the Portal is not liable for (i) the information and other content integrated into third-party spaces or websites that may be accessed through hyperlinks or links, (ii) the information and other content from which the Portal is accessed by those means, (iii) the information and content of any other third-party website that is presented under the appearance or distinctive marks of the Owner of the Portal or licensed to the same by third parties.
The Owner of the Portal is not liable for the information, content of any type, products, and/or services offered and/or provided through the Portal by third parties, in particular for any direct or indirect damages, losses, claims, or expenses of any type that, linked to the above, may occur due to:
In addition, the Owner of the Portal is not liable for any content or statements that may be made in any forum or debate medium accessible from the Portal, with the User assuming exclusive liability for the consequences of any statement that they may make which contains illegal, defamatory, or immoral content. Notwithstanding the impossibility of controlling the statements that may be made on such media in advance, the Owner of the Portal reserves the right to impede or prohibit access to any user who inserts any content contrary to the law, to morality, or to public order into the Portal, furthermore reserving the right to exercise any legal means deemed appropriate to avoid this type of behaviour.
